Man facing felony charges in alleged assault

Macedonia -- The case of a city man charged with three felonies in connection with the alleged May 11 assault on a female family member will go before a Summit County grand jury.

According to Cuyahoga Falls Municipal Court records, Vincent G. Swaby, 33, pleaded not guilty to second-degree misdemeanor criminal damaging and unlawful restraint, a third-degree misdemeanor, and the case was sent to the grand jury for possible indictment.

Swaby did not enter a plea to second-degree felony assault, fourth-degree felony domestic violence and fourth-degree felony disrupting public service charges at a May 15 pretrial hearing.

Swaby was being held in Macedonia City Jail on a $25,000 bond May 19. Swaby's attorney, Jaye Schlachet, did not return a phone call seeking comment.

According to a police report, the female relative alleged she and Swaby were arguing at a home they share at about 3:45 a.m., when he attacked her with a pair of scissors, cutting her arm, and slapped her face.

The woman said that when she ran into a bathroom, Swaby knocked the bathroom door off its hinges. It fell on her, cutting her arm a second time and her leg, she said.

When she tried to call 911 from a house phone, the woman alleged Swaby cut the phone line.

The woman said she tried to leave in a vehicle, but Swaby closed the garage door, so she smashed her vehicle through it, causing considerable damage.

The woman drove to a service station and called police.

The Macedonia Fire Department treated her injuries there, but she was not transported to a medical facility, police said.

Police said that when they arrested Swaby, they discovered he had piled the woman's clothing in the middle of the garage and poured bleach over them.

Police said the disrupting public service charge was the result of Swaby allegedly disabling the phone while the woman was trying to make a 911 call.
